When I studies law there were a few subjects that I never really got the hang of. When I say, never really got the hang of, what I mean is I had absolutely no idea. I still don’t really. This doesn’t mean that I didn’t pass them, in fact I got quite decent marks in some of them. I could present the information ok, I just didn’t know what it all meant? Anyway, one such subject was Equity, and a key concept in this thing was estoppel. The thing I remember most about estoppel was a recent case (at the time) had held you could use it (whatever the hell it is) as a sword as well as a shield. For 15 years now I’ve occasionally wondered what this actually means and today, at last, Little Sis made it clear to me.
This is what happened - this morning I could not find my mobile phone. I searched everywhere - I called it three times, I was tearing my hair out. Finally I said to Little Sis who was calmly doing a puzzle - “Do you know where mummy’s mobile is?”. She said “Yes, come with me and I’ll get it for you”. She took me into her room and pulled the mobile out from under her pillow, I looked at her in stunned disbelief and said “How did it get there?”. She pointed her finger directly at me with one hand on her hip and said “Mummy, we are sharing it, you know, taking turns”.
So you see, Little Sis has helped me understand this concept where many law lecturers have failed. You are right Little Sis, like estoppel, sharing is a sword as well as a shield!
